This appeal seeks to overturn Mr. Smith’s conviction for false statements to an official, on the basis that the alleged false statements (concerning an FBI undercover operation that failed to result in criminal activity) were not material. Ms. Allie Hallmark argued the case on behalf of CLCMA along with Mr. James Kilbourne, Mr. Smith’s court-appointed attorney.
