In response to Israel’s ongoing military actions in Gaza and the United States’ political and military support of those actions, there has been a sharp rise in political speech, protest activity, and advocacy across the country. At the same time, a series of troubling executive orders and expanded law enforcement initiatives have significantly altered the legal terrain for activists, nonprofits, attorneys, and community organizations.

Most notably, the U.S. Attorney General has established a new Task Force within the Department of Justice’s National Security Division focused on prosecutions related to October 7 and alleged support of Hamas, mirroring the structure and scope of the January 6 Task Force. Known informally as the “10/7 Task Force,” this initiative is charged with investigating terrorism-related offenses and civil rights violations tied to individuals and entities in the United States accused of providing material support or financing to Hamas, Iranian proxies, or affiliated organizations.

This CLE will provide attorneys with critical tools to understand and navigate this rapidly expanding national security enforcement framework.

This CLE will cover:

  • The framework of free speech protections under the First Amendment in federal criminal law

  • The Material Support of Terrorism statutes, with a focus on First Amendment–protected activity and its limits

  • An overview of current cases, enforcement trends, and potential risks facing activists, nonprofits, donors, students, and legal practitioners

  • How attorneys can issue-spot for national security–related criminal exposure in advising clients within this evolving legal landscape
